Abdicating Dead's Affairs to other Person by the Executor

Issue No. 2341- After the testator dies, the executor cannot appoint another person to execute the Will and keep aloof himself. However, if he knows that the deceased did not mean that the executor should perform the task himself and what he wanted was only that the task be accomplished, he may appoint another person as his agent.

Absence of the Object on Which Performing Sajdah Is Allowed

Issue No.971- If a person does not possess anything on which it is allowed to perform sajdah, or even if he possesses such a thing, but cannot perform sajdah on it due to severe heat or cold, he should perform sajdah on his clothes if made of linen or cotton. If his clothes are made of other fabrics, e.g., wool, he should perform sajdah on them or on the carpet, and in case this is not possible, he can perform sajdah on metals or mineral materials. If however, he cannot find anything at all on which to perform sajdah, he may perform sajdah on the back of his hand. Therefore, the back of one’s hand should be regarded as the last thing on which he may perform sajdah.

Acceptance is not Necessary In Tamlikiyah

Issue No. 2328- If a person makes a Will that something from his property should be given to someone, that thing becomes his property after the death of the testator and acceptance will not be necessary either. However, if that person rejects it during the lifetime of the testator, the obligatory precaution is that he should not appropriate that property as a possessor.

Acquiring Clothing to Offer Prayer In

Issue No.769- If a person does not have clothes with which prayer is permissible, it is obligatory for him to acquire, rent or purchase some, if possible. If someone presents or lends him clothes, and its acceptance does not entail hardship or any sense of obligation towards the individual, he should accept it.

Acting Upon the Stipulations

Issue No. 1222- If it is agreed with the hired person that he will perform the qaḍā of prayer and fast in a particular manner, (for example, it is agreed that he should offer the prayer in the mosque or at a special time), the hired person should follow the agreement. However, if nothing has been agreed, then he can perform according to his own obligation and as usual. As for performing the mustaḥab acts, he should perform the mustaḥab acts that are usually performed and it is not necessary to offer more than that, unless it has been stipulated. It is also not necessary to offer āyāt Prayer either, unless it has been agreed and stipulated before.

Acting according to Precaution

Issue No.1- It is not permissible for a Muslim to follow a Mujtahid in the fundamentals of religion; he must believe in them with his own insight and understanding. However, he should follow a Mujtahid in the branches of religion, i.e., practical laws or codes of practice. If he himself is a Mujtahid (a jurist who is capable of inferring and deducing divine laws from religious jurist who is capable of inferring and deducing divine laws from religious sources), he can act upon his own views but if he is not a Mujtahid, he should follow an expert in this field in the same way as people, who do not have the expertise and information in some matters, refer to experts and seek their advice. He who is not a Mujtahid can also act on such precaution that should assure him that he has fulfilled his religious obligations. For example, if some Mujtahids consider an act to be haram while others say that it is mubāḥ (permissible), he should not perform that act. Similarly, if some Mujtahids consider an act to be obligatory (wājib) while others consider it to be mustaḥab (recommended), he should perform it. However, since it is difficult to act on precaution (iḥtīyāṭ) as, relatively speaking, it demands a considerable amount of knowledge on Islamic jurisprudential issues, the best way for the general public is to refer to a Mujtahid and follow him.

Acting without Taqlīd

Issue No.14- If a person performs his acts for some time while not following a Mujtahid, and later follows a Mujtahid, his former actions will be valid if they are in accordance with the fatwās of that Mujtahid, otherwise, he should inquire the Mujtahid's view about his acts and act accordingly. In the same manner, he should repeat the acts where he has followed a Mujtahid without sufficient investigation.
